Device and Usage Data
When you visit momentumxix.com, Squarespace and other enabled website technologies may collect and store information about your visit, such as device, browser, usage, interaction, and basic analytics data. This information may be used to operate the website, understand general website activity, improve user experience, and maintain security.
Data We Collect from Third Parties
We may receive limited personal information from third-party platforms and service providers that help us operate our services, including Squarespace, Google Workspace, Stripe, PayPal, Meetup, Eventbrite, Bronx Yoga LaSalle or its connected booking and payment platforms for sound bath events or partner-hosted experiences, and similar enabled tools. These third parties have their own privacy practices, and information you provide directly to them may also be governed by their privacy policies.
Our websites and services may contain links to other websites, applications and services maintained by third parties. The information practices of such other services, or of social media networks that host our branded social media pages, are governed by third parties’ privacy statements, which you should review to better understand those third parties’ privacy practices.
Purpose and Legal Basis for the Processing of Personal Data
We collect and use personal information only for identified and appropriate purposes, including to respond to inquiries, provide coaching services and related offerings, manage bookings and events, process payments, communicate with you, maintain service records, operate and improve the website, meet legal and administrative requirements, and protect the confidentiality and security of our services.
We rely on consent where required, including express consent where appropriate and implied consent where permitted by law based on your relationship with us or the nature of your request. We also process information where necessary to provide requested services, administer bookings or payments, comply with legal obligations, protect legitimate business interests, or maintain confidentiality and security. You may withdraw consent at any time, subject to legal, contractual, administrative, or service-related limits, by contacting us using the information in the Contact Us section.
We do not use automated decision-making or profiling systems that produce decisions with legal or significant effects on individuals.
International Data Transfer and Storage
Some service providers may process or store personal information outside Québec or Canada. Before using service providers or technologies that may involve cross-border processing, we consider the sensitivity of the information, the purposes of processing, the safeguards offered by the provider, and applicable legal requirements. Where required by Québec Law 25, we conduct a Privacy Impact Assessment (PIA) before communicating personal information outside Québec, to ensure that the information receives adequate protection. Personal information processed outside Québec or Canada may be subject to the laws of the jurisdiction where it is processed or stored.
Microsoft OneNote, used solely for anonymized coaching process notes, and Microsoft Excel, used solely for anonymized session logs, may store data on servers outside Québec or Canada. As these records are anonymized and do not contain directly identifying information, the associated privacy risk is limited; however, we have considered these transfers as part of our assessment of service provider practices.
Sharing and Disclosure
We only share your personal data with third parties as described in this Policy or as explained to you at the time of collection.
Legal Requirement
We may use or disclose your personal data in order to comply with a legal obligation, in connection with a request from a public or government authority, or in connection with court or tribunal proceedings, to prevent loss of life or injury, or to protect our rights or property. Where possible and practical to do so, we will tell you in advance of such disclosure.
Service Providers and Other Third Parties
We may use service providers and platforms to operate our website and services, including Squarespace for website hosting and basic analytics, Google Workspace for booking, email, calendar, and appointment communications, Stripe for payment processing connected to Google Workspace booking, PayPal for some workshops and event experiences, Meetup and Eventbrite for event promotion, registration, and attendee communications, Bronx Yoga LaSalle or its connected website, booking system, and payment platform for some sound bath events and partner-hosted experiences, Microsoft OneNote for anonymized coaching process notes, and Microsoft Excel for anonymized session logs. These service providers and third-party platforms may process personal information only as needed to provide their services, support our operations, coordinate events, comply with law, or maintain security.
For some sound bath events or partner-hosted experiences, registration, payment, and event administration may be handled through Bronx Yoga LaSalle’s website, booking system, payment platform, or connected tools. Information provided directly through those platforms may be collected and processed by Bronx Yoga LaSalle and/or its service providers according to their own privacy practices, while we may receive limited information needed to coordinate the event, communicate with attendees, and provide the experience.
3| Cookies
What are Cookies?
A cookie is a small text file that your browser stores on your device when you visit a website. The information in this file is typically shared with the owner of the site, as well as potential partners and third-party service providers. This data is used to keep the website running securely, remember your preferences, and analyze visitor traffic to improve your user experience.
Categories of Cookies We Use
Essential Cookies: These are strictly necessary for the website to function securely and properly. They allow you to navigate the site, use secure areas, and load pages. These cannot be turned off because the website cannot function without them.
Performance and Analytics Cookies: We use Squarespace Analytics to collect basic, aggregated usage data (such as which pages are visited most often). This helps us understand how visitors interact with our content and optimize our business layout.
Third-Party Integration Cookies
Because we use trusted external platforms to manage our operations, certain integrated features may drop cookies on your device when you interact with them:
Payment Gateways (Stripe & PayPal): When you process transactions, these platforms deploy security and fraud-prevention cookies to verify payment legitimacy.
Event Scheduling (Eventbrite & Meetup): Clicking embedded elements to register for workshops or join our community groups may trigger tracking cookies subject to those platforms’ respective privacy policies.
Your Choices and Consent (Law 25 Compliance)
In accordance with Québec’s Law 25, all non-essential cookies are blocked by default and will not be placed on your device unless you actively click “Accept” on our website’s cookie banner.
You can change your mind or withdraw your consent at any time using either of the following methods:
On Our Website: Click the “Cookie” link/icon located in the footer of our website to reopen the preference banner and adjust your settings.
In Your Browser: You can configure your web browser (e.g., Chrome, Safari, Firefox, Edge) to block or delete cookies entirely. Note that disabling essential cookies may impact your ability to use certain functionalities on our site.
4| Retention & Deletion
We retain personal information only for as long as necessary to provide our services, manage bookings, process payments, meet legal or administrative requirements, or resolve disputes.
Client Records & Communications: Inactive client files, intake forms, and corresponding communication history will be securely destroyed or permanently anonymized three (3) years following the formal termination of the professional coaching relationship, unless ongoing retention is required for legal or tax purposes.
Coaching Process Notes: Professional process notes kept in Microsoft OneNote and session logs kept in Microsoft Excel are anonymized immediately during documentation. Because these notes are structurally unlinked from client identities, they do not constitute personal information and may be kept securely for ongoing professional development and practice reflection.
5 | How We Keep Your Data Safe
We maintain appropriate technical, administrative, and organizational safeguards to protect your personal data from accidental loss, unauthorized access, alteration, or disclosure.
Our website uses HTTPS/SSL encryption to secure communications between your browser and our servers. Squarespace provides and fully manages these automated SSL certificates natively. Furthermore, administrative access to our primary cloud platforms (Google Workspace, Squarespace, Stripe, PayPal) is restricted behind complex credentials and mandatory multi-factor authentication (MFA).
In the event of a suspected or confirmed confidentiality incident (data breach), we will promptly notify affected individuals and the appropriate regulatory bodies whenever we are legally required to do so. In accordance with Québec Law 25, we maintain a dedicated Register of Confidentiality Incidents that records all data protection events, which is kept on file for a minimum of five years.
6| Your Rights for Your Personal Data
Under Canadian and Québec privacy legislation, you hold specific legal rights regarding the personal information we maintain about you. These include:
Right to Access: The right to request confirmation of whether we are processing your personal data and to obtain a clear copy of that information.
Right to Rectification: The right to request the immediate correction of any incomplete, inaccurate, or outdated personal information we hold about you.
Right to Erasure (De-indexing): The right to request that we delete or stop distributing your personal data, subject to legal, regulatory, or administrative record-keeping obligations.
Right to Portability: The right to receive the personal data you provided to us in a structured, commonly used, and machine-readable format, or request that it be transferred directly to another data controller.
Right to Withdraw Consent: You have the right to withdraw your consent to data processing or marketing communications at any time, free of charge. You can unsubscribe from marketing emails instantly via the link in the footer.
How to Exercise Your Rights
To exercise any of these privacy rights, please submit a written request directly to our Privacy Officer using the contact details below. For security purposes, we may require you to verify your identity before processing or releasing personal data records.
7| Changes to This Policy
We may modify this Policy at any time to reflect operational, software, or regulatory changes. When updates are published, the revised date at the bottom of this document will be amended.
8| Contact Us
For any privacy questions, access requests, data corrections, or complaints, please reach out to our designated Privacy Officer.
